Website Tips - Protecting your Websites Legally

Affiliate Marketing, Webmaster/Website Optimization Do-Follow Comments

Often we have so much to focus on in our Internet marketing strategies, that important logistics maybe overlooked when building our websites and blogs.

It is really important to protect yourself from legal action in regards to your websites, whether you are selling physical products, have an affiliate marketing website, an informational website or blog or even just a personal website you run for fun.

Legal Protection is Important:

1. You can be sued by some idiot who, for instance, uses the information on your websites and does not get the result he wants and so then he files a suit against you.

2. He may file a suit against you for some action of the merchant your are an affiliate for.

3. Another idiot can steal serious amounts of content from your websites.

4. Evil lawyers are out there trolling for vulnerable websites to take advantage of.

These are just some examples of the horror stories that could take place. In the end, a website is in many ways the same as a business, your business, and therefore requires to be treated as such.

For example, if you provide information or guidance of any kind, a disclaimer should make it clear that you are in no way to be held responsible for the outcomes of individual experiences and that you make no guarantees as to those outcomes, and readers should do their own research or take actions at their own risk.

Website Tips - Protect Yourself:

Research all the options available to protect yourself and your websites, including, Privacy Policy, Terms of Use, Disclaimer or a combination of such to post on all of your websites. Website design wise, these are usually linked to from the footer.

1. Hire an attorney to create these for your websites, this way you are sure to cover all the legal basics with your respective jurisdications and laws.

2. Free services are available that will create documents, referring to US law. Make sure to read what is generated and that these will work for you:

Priority Digital - Free Site Disclaimer

Contract Store - Free Privacy Policy

Free Net Law - Variety of Free Documents

3. For $15 you can purchase legal agreements from FindLegalForms.com they included a Governing Jurisdiction of the Courts provision. Basically, the provision requires anyone filing a lawsuit to be bound by the laws in your state and keeps someone from filing a lawsuit on the other side of the country and requiring you to show up and fight it.

You know I have been working on a disclaimer for my blog for months now and have yet to get it done. Thanks for the links, I will check them out today.

I have always wondered about posts that may piss a company off if they would try to pull some lawsuit or not.

    @ Tara
I recently heard of a horror story where the webmaster got sued for some nonsense and he actually HAD to settle and mainly because he had no legal disclaimers on his site, well he does now, but he had to pay a settlement and thousands in lawyers fees for the lawsuit. It is really critical to have these on all websites. It’s a scary thing, especially for us bloggers who give advice. You can check out mine, on this blog, they are simple and to the point regarding the information I provide.

very nice. I was thinking about that this week and it’s extremely important to protect yourself. I think hiring someone to do the job is the best thing to do, because you’re sure to cover everything in your legal documents.
